Termination of Temporary General Order 20-03 - SDIL Bankruptcy Court

Members of the Debtor’s Bar –

 

On March 16, 2020, the Court entered Temporary Order 20-03, which allowed my office to commence disbursements immediately following the initial 341 date, regardless of whether or not it was concluded.  The Court has now vacated that Temporary Order effective January 1, 2023.  See, General Order 22-01. 

Accordingly, on all cases filed on or after that date, my office will return to our regular procedure and not commence disbursements until after the 341 meeting has been concluded.

To assist you in ensuring that we have the documents necessary to conduct the 341 meeting, below you will find a summary of the required documents needed: 

  • Account statements evidencing the date of filing balance for every financial account, including cash transfer apps/peer-to-peer money transfer services (ex., Cash App, Venmo, etc.);
  • Complete copies of the prior year’s state and federal income tax returns, or an affidavit stating tax return(s) were not required;
  • State issued identification and proof of SS#;
  • P&L statements for the last 60 days, if applicable;
  • 60 days of pay advices for each Debtor;
  • 122C-2 Lines 28, 29, 30 proof of expenses, if applicable.

All of the above documents must be submitted to our office via our encrypted portal at bkdocs.us (formerly 13documents.com) and must be received at least 7 days prior to the meeting date.  Please note that, unless specifically requested, 341 documents sent directly to our office will be deleted.
