    BASIL is aware of the following notice from Chapter 13 Trustee - Russell Simon regarding Pre-trials, Tax Refunds, 341 Meetings and various Motion matters:


    Members of the Debtor(s)’ Bar –

     

    We are now 2 years into the pandemic and I would like to congratulate everyone for a job well done as we have adapted to these trying times.  As we all know, case filings remain at decreased levels, although the monthly numbers are remaining fairly static. 

     

    In an effort keep each of you updated, as well as to streamline several of the more common motions that are being filed, I offer the following updates and suggestions that may assist you. 

     

    Remote 341 Meetings:

     

                    It appears that remote 341 Meetings are here to stay; however, they will soon transition to being conducted via Zoom.   While I do not have specific time table as to when this conversion will take place, it is my understanding that if someone is unable to participate on the Zoom platform, an in-person meeting will be required (subject to any then current pandemic protocols). 

     

    Motions to Terminate Garnishment:

     

                    If your client’s Plan base has been paid in full and you wish to proactively terminate any Wage Order in effect, you can now send us an email requesting pre-approval.  Upon receipt, we will verify that the plan base has been paid in full and, if so, approve your request.  This will permit you to file either (i) an Agreed Motion or (ii) set forth in your Motion that the Trustee has no opposition to the relief sought.

     

    Motions to Retain Tax Returns:

     

                    For those Plans currently proposing to pay 100%:

     

    You may request pre-approval from our office to retain any tax refund, provided your Motion and Order state if the Plan ever amends to less than 100%, you agree to provide that any resulting pool to be no less than the retained tax refund (less Trustee’s fees) plus any previously required/agreed pool amount.  Upon such a request, we will confirm that the Plan is 100% and the Debtor(s) is/are substantially current and, if so, approve your request.  This will allow you to file either (i) an Agreed Motion or (ii) set forth in your Motion that the Trustee has no opposition to the relief sought.

     

                    Plan will be amended to pay the refund over the course of the case:

     

    Upon such a request, we will confirm that the Debtor(s) is/are substantially current and, if so, approve your request.  This will allow you to file either (i) an Agreed Motion or (ii) set forth in your Motion that the Trustee has no opposition to the relief sought.

     

    Motions to Approve Settlements:

     

    Once an agreement has been reached with our office regarding the estate’s portion of any financial recovery, you may you to file either (i) an Agreed Motion or (ii) set forth in your Motion that the Trustee has no opposition to the relief sought, provided the Motion and the Order both set forth that upon payment of such funds, the Trustee shall be entitled to increase the Plan base by the amount of such funds; increase the pool by a like amount (less Trustee’s fees) and be authorized to disburse such funds in accordance with the Order of Distribution.

     

    All request for pre-approval should be sent to either Mary or I.  Additionally, if you would like, you can send us a sample Motion/Order to review so that you will then have a template to utilize going forward.  It is our goal to respond that same day so that you may get your Motion on file.

    Land of Lincoln Legal Aid has provided the following informational supplement regarding the Department of Treasury Emergency Rental Assistance Program:


    As a follow up, at Land of Lincoln we’ve been finding it has been hard to connect with the agency who is assigned to cover the southern half of Illinois.  It is my understanding they are doing the best they can but have limited staff to face the onslaught of need.  Since that is the case, several other agencies have been given more money and they are supposed to accept ANY rental application REGARDLESS OF location. We’ve been able to connect with two of these agencies to confirm they will accept applications outside of their listed service area.  Most notably- Quad City Community Development Center in Southern Illinois did confirm they’ll accept applications for anyone in Southern Illinois.

     

    Please feel free to pass this along bankruptcy attorneys so they can provide it to debtors.

    Please see the following from the United States Trustee's Office:

    With the expiration of the moratorium on evictions and millions of American households facing displacement from their homes in the coming months, I am reaching out to seek your assistance.  I am hoping you can help us in raising awareness about the Department of Treasury’s Emergency Rental Assistance (ERA) program through the distribution of the attached: 

    (1) UST Region 10 Notice;

    (2) one page USTP Informational Notice on Emergency Rental Assistance Program (Spanish); and

    (3) one page USTP Informational Notice on Emergency Rental Assistance Program (English), to any and all BASIL members who may find the information helpful.

     

    As the attached UST Region 10 Notice indicates, through funding from the Department of the Treasury’s Emergency Rental Assistance (ERA) program, there are a wide variety of state, territorial, tribal, and local government programs that have been tailored to address the special needs of communities during these difficult times.  The U.S. Trustee Program (USTP) has partnered with the Treasury Department to help raise awareness about ERA in the hopes of helping individuals to avoid bankruptcy altogether or, at a minimum, better position debtors to exit bankruptcy successfully.

    Our office is modifying and improving the manner documents are submitted electronically to our office.  The new portal for document submission is called 13documents.com.

    My office has contracted with this site to allow a secure and more detailed handling of the documentation you submit to our office.  By utilizing this new site, your documents will be encrypted from the time you send them over the web, thus eliminating the unencrypted transmission of such information through regular email.  Furthermore, it not only creates a history record with a date/time stamp for each submission, but you can also return to the site to review exactly what you had sent previously. 

    As with our previous document submission procedure, we are accepting the following documents through 13documents.com:

    On September 23, 2020 BASIL had a membership meeting and elections were conducted.  The new officer slate had been approved by the board and were submitted to the membership.  A Treasurer's Report was presented.  A copy of the Report is available in the "Members Only" section of the website.

    1.  Due to the restrictions associated with the pandemic Corona Virus, BASIL will be postponing the seminar in April to a later date.  Our current tentative date (pending availability of panelists, venue, and lifting of restrictions associated with Corona Virus) is on or about Friday, October 23.  Further updates and announcements will be released as we get closer to the NEW Seminar date.  We are thankful for all the hard work our panelists, organizers and membership volunteers have done to help facilitate our seminars.  We plan on transferring all who have currently registered and paid for the BASIL seminar April date to the new tentative October date.  If you need a refund because the new date won't work, please contact our Treasurer, Justin Farishon.

    2.  Given this situation we are also inviting the membership to take time to consider any questions or scenarios they may wish to submit to a member of the Executive Committee pertaining to one of the panel topics.  This would give the panelists time to potentially incorporate the questions/scenarios/issues into the postponed presentation.

    3.  BASIL would remind all attorneys that everyone is still responsible for reporting your CLE hours if you are in a reporting year.  Since BASIL won't be able to assist with providing CLE hours before the June reporting date we would encourage you to consider free online alternatives such as those offered by the MCLE Board at the following website:  https://www.mcleboard.org/

    4.  NOTICE to BOARD OF DIRECTORS - The Board of Directors Meeting that was scheduled for the Annual Seminar will be postponed due to the reasons outlined above.  We plan on rescheduling the Board of Director Meeting to coincide with the Summer Membership Meeting and Annual Election of Officers.  We will announce a date later in the year when we have a better idea of what meeting restrictions may be in place.  Keep a look out for a SAVE THE DATE for the Summer Membership Meeting and Board of Director Meeting - TBD.
